From a Legal Obligation to a Real Early-Warning System

The Starting Point

Since July 2023, companies and organizations with 50 or more employees have been required to set up an internal reporting office under the German Whistleblower Protection Act (HinSchG). In one concrete case, described here only in general terms, a report came in through the anonymous channel that pointed to internal processes with considerable risk for those affected and for the organization. Through the professional initial assessment, the report was qualified and separated from mere noise; in anonymous dialogue, open questions could be clarified without jeopardizing confidentiality. On the basis of the decision template, management was able to act before the matter turned into supervisory, financial, or public damage.

This is precisely the difference between a fulfilled obligation and a real early-warning system: the wrongdoing became visible early, was assessed objectively, and was resolved internally – instead of escalating.
