The Product Liability Act governs the manufacturer's strict liability for damage caused by defective products. Employees, suppliers and business partners are often the first to notice such defects – a whistleblower system gives them a protected, optionally anonymous way to report them. The company can then investigate and fix product risks before damage occurs. In addition, violations of product safety and conformity regulations fall within the material scope of the German Whistleblower Protection Act, so many companies are required to maintain a reporting channel for such reports anyway.

The new EU Product Liability Directive (EU) 2024/2853 replaces the previous directive from 1985 and must be transposed into German law by December 2026. It explicitly extends the definition of a product to include software and AI systems, eases the burden of proof for injured parties and extends liability periods. This increases the liability risk for manufacturers – and with it the value of early internal reports of product defects.
